By accessing or using our website or services, you agree to comply with and be bound by the following terms and conditions ("Terms"). Please read these Terms carefully before using our website or services.


Use of Website and Services:

You must be at least 18 years old to access or use our website or services.

You agree to use our website and services for lawful purposes only and in compliance with all applicable laws and regulations.

You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.


Training Courses:

Our training courses are offered for educational and informational purposes only. Completion of a training course does not guarantee any specific outcome or qualification.

Individuals under the age of 18 may be permitted to participate in our classes if accompanied by a parent or legal guardian. We believe in promoting responsible firearms education and safety practices, and we welcome the opportunity to educate young individuals under appropriate supervision. However, please note that the accompanying adult must assume full responsibility for the minor's conduct and safety during the class. Additionally, the accompanying adult must provide written consent for the minor's participation in the class. For further inquiries regarding minors attending our classes, please contact us.

You are responsible for ensuring that you meet any prerequisites or requirements for participation in a training course.

We reserve the right to cancel, reschedule, or modify any training course at our discretion.


Intellectual Property:

All content and materials available on our website or provided as part of our services, including but not limited to text, graphics, logos, images, and videos, are the property of Fired Up Firearms Training or its licensors and are protected by copyright and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any content or materials without our prior written consent.


Limitation of Liability:

To the fullest extent permitted by law, Fired Up Firearms Training shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way related to your use of our website or services.

In no event shall our total liability exceed the amount paid by you for the services provided.


Indemnification:

You agree to indemnify and hold harmless Fired Up Firearms Training, its officers, directors, employees, contractors and agents, from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of our website or services or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.

Waiver and Release of Liability:

By participating in any firearms training activities, including but not limited to classes, workshops, range sessions, or other events (hereinafter collectively referred to as "Activities") offered by Fired Up Firearms Training, LLC (hereinafter referred to as "the Company"), you acknowledge and agree to the following:


Assumption of Risk: You understand and acknowledge that participating in firearms training Activities involves inherent risks, including but not limited to the risk of bodily harm, injury, or death, as well as property damage. You voluntarily assume all risks associated with your participation in the Activities.


Participant Responsibilities: You are responsible for your own safety and well-being during firearms training activities. You agree to comply with all safety instructions and guidelines provided by the Company and its instructors. Failure to do so may increase the risk of injury or harm to yourself and others.


Training Environment: Firearms training activities may take place in various environments, including indoor and outdoor shooting ranges, simulated training facilities, and other locations. You acknowledge that these environments may present additional hazards and risks, such as uneven terrain, inclement weather, and limited visibility.


No Guarantee of Results: The Company makes no guarantees or warranties regarding the outcome of firearms training activities, including but not limited to improvements in shooting proficiency or skills. Results may vary depending on factors such as individual aptitude, practice, and adherence to instruction.


Release of Liability: To the fullest extent permitted by law, you hereby release, waive, discharge, and covenant not to sue the Company, its officers, directors, employees, agents, representatives, instructors, contractors, and affiliates (collectively referred to as "Released Parties") from any and all claims, liabilities, damages, losses, or expenses arising out of or in any way related to your participation in the Activities, including but not limited to claims for personal injury, wrongful death, property damage, or loss.


Indemnification: You agree to indemnify and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, or expenses (including attorney's fees) arising out of or in any way related to your participation in the Activities or your violation of any terms of this agreement.


Limitation of Liability: In no event shall the Company or its Released Parties be liable to you or any third party for any direct, indirect, incidental, consequential, special, or punitive damages arising out of or in any way related to your participation in the Activities, even if the Company has been advised of the possibility of such damages. The total liability of the Company and its Released Parties, whether in contract, warranty, tort (including negligence), or otherwise, shall not exceed the amount paid by you, if any, for the Activities.


Severability: If any provision of this Waiver and Release of Liability is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


Governing Law: This Waiver and Release of Liability shall be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law principles.


Acceptance of Terms: Your participation in firearms training activities constitutes your acceptance of these terms and conditions. If you do not agree to these terms, you should not participate in these activities. By accessing or using the Company's website or participating in any Activities, you acknowledge that you have read, understand, and agree to be bound by this Waiver and Release of Liability.




Refund Policy:

We strive to provide excellent service and flexibility to our students. Please read our refund policy carefully to understand your rights and responsibilities regarding refunds and rescheduling.


Cancellation for Refund:

Students are required to cancel their class reservation at least 48 hours in advance of the scheduled class date to be eligible for a full refund.

Classes cancelled less than 48 hours before the scheduled class date will not be eligible for a refund.


Rescheduling:

If you are unable to attend a class and wish to reschedule for a different date, you must notify us at least 48 hours before the original class date.

Rescheduling requests made less than 48 hours before the original class date may not be accommodated and may result in forfeiture of your registration fee.

Refund Process:

Refunds for eligible cancellations will be processed within 5 business days from the date of cancellation.

Refunds will be issued using the original method of payment.


Exceptions:

In exceptional circumstances, such as documented medical emergencies or unforeseen circumstances beyond the student's control, we may consider refund requests for cancellations made within 48 hours of the class date. Please contact us with any such requests, providing appropriate documentation for review.


No-Shows:

Failure to attend a scheduled class without prior cancellation or rescheduling notification will result in forfeiture of your registration fee.


Policy Updates:

We reserve the right to update or modify this refund policy at any time without prior notice. Any changes will be effective immediately upon posting on our website.

By registering for a class with us, you acknowledge that you have read, understood, and agreed to abide by this refund policy.
